This AI & Voice Features Policy ("Policy") supplements and is incorporated into the WorkSherpa Terms of Service ("Terms"). It describes how WorkSherpa's artificial intelligence and voice-enabled features work, their limitations, and your responsibilities when using them. Capitalized terms not defined in this Policy have the meanings given in the Terms.
If there is a conflict between this Policy and the Terms, the Terms control, except that this Policy governs where it imposes additional or more specific obligations regarding AI Features or Voice Data.
This Policy applies to all AI Features made available through the Services, including AI-generated estimates, proposals, email drafts, summaries, scheduling suggestions, workflow automation, and voice capture and transcription. WorkSherpa may update this Policy from time to time as AI Features evolve, in accordance with Section 7 below.
AI Features are designed to help you work faster by drafting content and surfacing suggestions. They do not replace your judgment. You are responsible for every business, pricing, staffing, legal, and customer-facing decision made using or informed by AI Output, and for reviewing AI Output before you rely on it or share it with anyone.
AI Output is generated using probabilistic models and may be inaccurate, incomplete, outdated, or unsuitable for your situation. WorkSherpa does not guarantee that AI Output is correct, complete, or compliant with applicable law. Treat AI Output as a first draft, not a verified fact or finished product, and review it before you:
WorkSherpa is not liable for outcomes resulting from AI Output that was not reviewed before use.
WorkSherpa's voice features may capture, record, and transcribe audio ("Voice Data"), including calls and voice notes. Before recording or transcribing any conversation involving a third party — such as a customer, employee, or contractor — you are responsible for:
Voice Data is stored and processed in accordance with WorkSherpa's Privacy Policy. WorkSherpa is not responsible for your failure to obtain required consents before recording a conversation.
AI Features may be powered by WorkSherpa's own models, by models operated by trusted third-party AI providers, or by a combination of both. When Customer Data is sent to a third-party AI provider to generate AI Output, that provider processes the data only to deliver the requested functionality and is contractually prohibited from using it for its own independent purposes.
WorkSherpa will not use your identifiable Customer Data to train proprietary AI models for the benefit of other customers or the public without your prior consent. WorkSherpa may use de-identified, aggregated, or anonymized data to improve and develop the Services, including AI Features, in a way that does not identify you or any individual.
WorkSherpa may update, retrain, reconfigure, or replace the models and providers behind its AI Features at any time to improve performance, accuracy, security, or legal compliance. These changes may affect the style, format, or content of AI Output. WorkSherpa will use commercially reasonable efforts to maintain the core functionality described in the Documentation and will provide notice of material changes to AI Features in accordance with the Terms.
AI Output such as estimates and proposals may incorporate product, pricing, and availability information sourced from third-party retailer websites, catalogs, or feeds ("Retailer Data"). Retailer Data can change frequently and may not reflect the retailer's current price or availability at the time you use it. Before finalizing any estimate, proposal, or purchase, verify current pricing and availability directly with the applicable retailer. WorkSherpa is not liable for discrepancies between Retailer Data shown in the Services and a retailer's actual pricing.
Subject to the rights of any underlying third-party AI provider and applicable law, you may use AI Output generated in your Workspace for your own internal and customer-facing business purposes. WorkSherpa does not claim ownership of AI Output generated for your Workspace. Because similar inputs can generate similar output for other customers, WorkSherpa does not represent that any AI Output is unique or exclusive to you.
WorkSherpa does not provide legal, accounting, engineering, tax, insurance, employment, or other professional advice, and AI Output should never be treated as such. AI Output is provided for general informational purposes only. Consult a qualified professional before making decisions based on AI Output that involve legal, financial, safety, or regulatory matters.
